OVERVIEW

Welcome to RuffTop. The terms "we", "us" and "our" refer to RuffTop. RuffTop operates this store and website, including all related information, content, features, tools, products and services (the "Services"). RuffTop is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you use the Services.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our Services.

Nothing in these Terms affects your statutory rights as a consumer under UK law.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms, you confirm you are at least 18 years old.

To use the Services, including browsing our store or purchasing products, you may be asked to provide information such as your email address, billing, payment and delivery details. You confirm that the information you provide is accurate and complete.

You are responsible for keeping your account details secure. You may not transfer, sell or assign your account to anyone else.

SECTION 2 — OUR PRODUCTS

We make every effort to describe and picture our products accurately. Colours and appearance may look slightly different on your screen depending on your device and its settings.

All product descriptions may change at any time. We may discontinue any product and may limit quantities available to any person or region.

This does not affect your rights under the Consumer Rights Act 2015 to goods that are of satisfactory quality, fit for purpose and as described.

SECTION 3 — ORDERS

When you place an order you are making an offer to purchase. We may accept or decline an order at our discretion. A contract is formed only when we confirm acceptance, normally by email. We must receive payment before an order is accepted.

If we decline, change or cancel an order, we will contact you using the details you provided.

Your right to cancel an order after it has been accepted is set out in our Returns & Refunds Policy and in Section 4 below.

SECTION 4 — YOUR RIGHT TO CANCEL

If you are a consumer in the UK, you have the right to cancel your order within 14 days of receiving the goods, without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

You then have a further 14 days to return the goods. We will refund you within 14 days of receiving them back.

SECTION 5 — PRICES AND PAYMENT

All prices are shown in pounds sterling and include any applicable taxes. Delivery costs, where they apply, are shown separately and clearly before you complete your order. The total price you will pay is shown at checkout before payment.

The price charged will be the price in effect when you place your order, as confirmed in your order confirmation email.

Prices and promotions may change, but changes will not affect orders already placed. Where a promotion has its own terms, those terms apply.

You confirm that the payment details you provide are accurate and that you are authorised to use the payment method.

SECTION 6 — DELIVERY AND RISK

We will deliver your order within the timeframe shown on the product page. Delivery times are estimates and may be affected by carriers, customs or events outside our control. If delivery is significantly delayed, contact us and we will keep you updated or refund you.

Goods remain at our risk until they are delivered into your physical possession. If your order is lost or damaged in transit, contact us and we will replace it or refund you in full.

If we fail to deliver within 30 days of the contract, or within any longer period we have agreed with you, you may cancel and receive a full refund.

SECTION 7 — FAULTY GOODS

Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described.

If goods are faulty you have a short-term right to reject them and receive a full refund within 30 days of delivery. After that you are entitled to a repair or replacement, and to a partial or full refund if a repair or replacement is not possible or does not resolve the fault.

Nothing in these Terms limits these rights.

SECTION 8 — INTELLECTUAL PROPERTY

Our Services, including all trade marks, text, images, graphics, video and audio, and the design and arrangement of them, are owned by RuffTop or its licensors and protected by UK and international intellectual property law.

You may use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, republish or transmit any material from the Services without our written consent.

RuffTop's name, logo and branding are our trade marks. Shopify's name and branding are trade marks of Shopify. All other trade marks belong to their respective owners.

SECTION 9 — OPTIONAL TOOLS

You may be given access to third-party tools through the Services which we neither monitor nor control. These are provided "as is" without warranties or endorsement, and your use of them is at your own discretion. You should review the relevant third party's own terms.

Any new features or tools we add later form part of the Services and are subject to these Terms.

SECTION 10 — THIRD-PARTY LINKS

The Services may link to websites operated by third parties. We are not responsible for the content or accuracy of those sites, and accessing them is at your own risk. Any questions or complaints about third-party products or services should be directed to that third party.

SECTION 11 — RELATIONSHIP WITH SHOPIFY

RuffTop is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with RuffTop. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and RuffTop, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with RuffTop.

SECTION 12 — PRIVACY

All personal information we collect through the Services is handled in line with our Privacy Policy and UK GDPR. Because the Services are hosted by Shopify, Shopify also processes personal data about your use of the site in order to provide and improve the Services. This may involve transfers to countries outside the UK, subject to appropriate safeguards. See our Privacy Policy for details.

SECTION 13 — REVIEWS AND FEEDBACK

If you send us reviews, suggestions, ideas or other content ("Feedback"), you grant us a worldwide, royalty-free licence to use, reproduce, modify, publish and display it, including for commercial purposes.

You confirm that you own the rights to any Feedback you submit, that it is honest and accurate, and that you will disclose any payment or incentive you received in connection with it. We do not offer payment or incentives in exchange for reviews, and we do not publish reviews that are not genuine.

We may remove Feedback that is unlawful, offensive, misleading or infringes anyone's rights. You must not submit Feedback under a false identity or misrepresent its origin.

SECTION 14 — ERRORS AND INACCURACIES

Occasionally information on the Services may contain errors or omissions relating to descriptions, pricing, promotions, delivery charges or availability. We may correct errors and update information at any time.

If we discover an error in the price of goods you have ordered, we will contact you and give you the option to continue at the correct price or cancel for a full refund. Where a pricing error is obvious and could reasonably have been recognised as an error, we are not obliged to supply at the incorrect price.

SECTION 15 — PROHIBITED USES

You may use the Services for lawful purposes only. You must not use them: for any unlawful or malicious purpose; to breach any applicable law or regulation; to infringe our intellectual property rights or those of others; to harass, abuse, defame or harm any person; to transmit false or misleading information; to send spam or unsolicited promotional material; to impersonate any person or entity; or to interfere with anyone else's use of the Services.

You also must not: upload viruses or malicious code; copy, resell or exploit any part of the Services; collect other people's personal data; use bots, scrapers, automated tools or AI agents to access the Services; or bypass any security measures.

We may suspend or terminate your access if you breach these Terms.

SECTION 16 — AUTOMATED AGENTS

This section applies if you use or deploy any software or service that takes autonomous or semi-autonomous action on your behalf (an "Agent") to interact with the Services.

Agents must identify themselves in all HTTP/HTTPS requests by including "Agent/[agent name]" in the user agent string; must not conceal that they are automated, mimic human interaction patterns, or circumvent CAPTCHAs; must answer truthfully if asked whether they are human; and must not bypass measures controlling automated access.

We may restrict or block Agent access by technical means.

SECTION 17 — TERMINATION

We may end this agreement or suspend your access to the Services at any time, and you remain liable for amounts owed up to that date. Termination does not affect any order already accepted or your statutory rights in relation to it.

Sections on intellectual property, feedback, disclaimers, limitation of liability, governing law and any others that by their nature should survive will continue to apply.

SECTION 18 — DISCLAIMER

Information on the Services is provided for general information purposes. We do not warrant that the Services will be uninterrupted, secure or error-free.

This disclaimer applies to the website and its content. It does not apply to the products you buy from us. Products are covered by the Consumer Rights Act 2015 and nothing here excludes or limits those rights.

SECTION 19 — LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under the Consumer Protection Act 1987, or for any other liability that cannot lawfully be excluded.

Subject to that, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence. We are not responsible for loss or damage that is not foreseeable.

We do not supply products for business use. If you use a product for any commercial or business purpose, we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

SECTION 20 — SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, it will be severed and the remaining provisions will continue in full force.

SECTION 21 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce any right or provision does not waive it. These Terms, together with our policies, form the entire agreement between you and us regarding your use of the Services.

SECTION 22 — ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations, and we will tell you if we do. If you are unhappy with the transfer you may cancel the contract and we will refund any payments made in advance for products not yet provided.

SECTION 23 — GOVERNING LAW

These Terms are governed by the law of Scotland. If you are a consumer, you may bring legal proceedings in the courts of the part of the United Kingdom in which you live, and nothing in these Terms affects your right to rely on any mandatory consumer protection provisions of your local law.

SECTION 24 — COMPLAINTS

If you have a complaint, email help@getrufftop.com and we will respond within 5 working days and aim to resolve it within 14 days. If we cannot resolve it, you may be able to take it further with Trading Standards via the Citizens Advice consumer service on 0808 223 1133.

SECTION 25 — CHANGES TO THESE TERMS

You can review the current version of these Terms at any time on this page. We may update them, and we will notify you of any material changes. Changes will not apply retrospectively to orders already placed.
